John Hayes

John Hays, Hayes, Haye, Hais, Hase ca/bef 1650 – est 1730 | his parents
of Bertie Precinct

Capt. Jacob John Hayes

This is my working hypothesis – the way I see it as of this moment!!

One John Hayes was son of Peter Hayes, the envoy who died in Va in 1668 per A E Hayes. [I have not checked this out further as of yet]
Jacob John Hayes, ship captain lived at Salmon Ck, NC
He was master of the “Constant” out of London.
He and his first mate Edward Cooke were subpoenaed to appear in court in London re. Bacon’s Rebellion.
Instead of Complying they left the sea and took up land “in Albemarle.”
He dropped the use of his first name and went by John.

  1. Hello,
What evidence to you have that Susannah Hayes, the daughter of Hardy Hays of Bertie County, NC is the Annie Hays (1774-1867), who married Henry Fiser possibly in Robertson County, TN ca 1805. I think these are two different persons. Henry Fiser moved to Robertson County, TN from Stokes County, NC around 1803 and first appears in the Robertson County, TN court minutes in 1804. In 1805, Henry Fiser and two brothers, Peter and and Michael are assigned by the Robertson County court to maintain a road west of Springfield along with William, Robert and James Hays. I have found nothing that connects these Hays with the Hayes in Bertie County, NC.

  2. Look for:

    Peter Hayes III
    son was:
Richard Hayes (1680- 1707), Bertie County
    son was:
Thomas Hayes (1695 – 1774) Married Sarah, Cashie Swamp
    Sons were:
    1. Peter Hayes V (1710-?) Married Bether ( Beatrix Watson) Note: not Peter Hayes of Yorahah. ( Peter Hayes IV never owned property on Cashie swamp, he owned property of south side of Antonkey Marsh ( Urahah swamp from Quarter Swamp to state road 305. Plaquet Branch is present day Dick Harmony Road.) Note that this Peter Hayes sold some land to his “””FATHER””” Thomas Hayes. Not Peter Hayes IV….. Peter Hayes and Bether Watson had a son named John Hayes.
    2. Richard Hayes (1711- Nov 1778) married Eddy.daughters were Penelopy and Levine.

  3. Dear Sally, DNA has “”””PROVEN”””””” that the Lucrecia who married Thomas Hays was the daughter of John Barnes Sr. of Bertie County.
Also Sawyer Hayes was Thomas Hayes “””BROTHER”””””
Thomas Hayes 1706 and Sarah his wife are not the parents of Sawyer. In fact “”””PETER HAYES IV NEVER OWNED PROPERTY ON CASHIE SWAMP”””””.
There is no Thomas Hayes 1726. “”””NOT POSSIBLE””””
The book “Hysterical Southern Families Vol XXIV” is wrong!!! NO JOHN SAWYER——– NO LUCY SAWYER—– B A R N E S !!!! Boddie was wrong!!!!!
    1. Only one Thomas Has who was born about 1715.
    2. Thomas Hays and Lucy Barns “””NEVER””” owned property on Cashie Swamp.
    3. The Thomas Hayes who lived on Cashie Swamp was the son of either John Hayes or Richard Hayes (died 1707 Bertie County) more than likely Richard.

    1. Hello my name is Steven Hayes direct decedent as far back as John Hayes born 1368 Leigh, Dorset England.. As far as I can see .. I like some help filling int he blanks.. My email hayessteve1970@gmail.com cell# 440-479-6922 .. thank you

  4. Hello,
I am a descendant of Annie (Hays) Fiser (1774-1867). I discovered her grave back in 1993 during a visit to Powell Cemetery. She is not the Susannah Hayes, listed in your tree as the daughter of Hardy and Sarah Hayes of Bertie County, NC. You list a birth date of 1783 for Susannah Hayes, but the birth date on Annie Fiser’s grave is 1774. The marriage date of October 23, 1801 for Henry Fiser and Annie Hays is highly questionable and has never been verified with any documentation. I will be happy to discuss this further.
