J
acob Perry’s Will, 4 March 1775 — died 1777 [recorded 24 Nov 1779]
In the name of God, amen, March 4, 1775, I, Jacob Perry, of Perquimans County in the province of North Carolina, being weak in body but of sound and perfect memory thanks be given to God for the cause and calling to mind the mortality of my body and knowing that it is appointed for all men once to die, do make and ordain this to be my last will and testament. That is to say. . . First and principally of all I give and recommend my soul into the hands of God that gave it me and for my body I recommend to the earth to be buried in a Christian-like and decent manner, according to the directions of my executors hereafter named, nothing doubting but at the general resurrection I shall receive the same by the almighty power of God and as touching such worldly estate wherewith it hath pleased God to bless me within this life, I give, devise and dispose of the same in manner and from the following—that is to say in the first place…
— I give and bequeath to my son Jacob Perry the land and plantation whereon he now lives in Perquimans County aforesaid to a line of marked trees mentioned in a deed of gift to my son Israel Perry which is supposed to contain about 187 1/2 acres to the same more or less to him, his heirs or assigns forever also such part of my personal estate with which he is now possessed with to him and his disposal.
— Then I give to my son Israel Perry all such part of my estate as he is now in actual possession of meaning among other things, 50 acres of land for which some years past acknowledged a deed of sale to him that through mistake happened to be without date, to him and his disposal.
— Then I give to my son Reuben Perry all such part of my estate as he is now in actual possession of to him and his disposal.
— Then I give to my daughter, Priscilla Welch, wife of Dempsey Welch, all such part of my estate as she is now in actual possession of to her and her own disposal.
— Then I give to my son Dempsey Perry all such part of my estate as he is now in actual possession of to him and his own disposal.
— Then I give to my son John Perry, [a negro or horse] named Dick and also such part of my estate as he is now in actual possession of to him and his own disposal.
— Then I give to my daughter Hephzibah Stallings, wife of Hardy Stallings, all such part of my estate as she is now in actual possession of to her and her own disposal.
— Then I give to my daughter Ann Winslow, wife of Caleb Winslow, land and plantation and improvements whereon I now live, also one plantation and improvements which I bought of Zachariah Lilley, also one plantation which I bought of my son Jacob, to her and her heirs forever, only my will is that the true intent and meaning of these presents also is that my well beloved Ann Perry shall have the use of the said lands during the time of her natural life without molestation.
— Then I give to my grandson Isaac Wilson, son of Isaac Wilson, a parcel of land lying on the northwest side of a place called the Little Beaver Dam in Chowan County, containing by estimation 100 acres to him and his heirs and assigns forever.
— Then I give to my well-beloved wife Ann Perry one horse call[ed] Spring, one woman’s saddle and bridle, one featherbed and furniture, also the use of the labor of my negro man named Tom and negro woman named Pat during the time of her natural life or widowhood, also the use of my copper still for the same time.
— Then I give to my 8 children sig: Jacob, Israel, Reuben, Priscilla, Dempsey, John, Hephzibah, and Ann my copper still and negroes Tom & Pat to be equally divided among them after the expiration of the time above limited to them and their disposal.
— Then I give all the rest of my estate to be equally divided between my wife Ann Perry, and my youngest daughter Ann Winslow, wife of Caleb Winslow, to them and their disposal.
— Then, lastly I do hereby nominate and appoint my well-beloved wife executress and Jacob Perry and Israel Perry and Caleb Winslow executors of this my last will and testament, hereby disannullin and disallowing all and any other forms, wills and testaments, legacies, bequeaths, or executors before this time by me named, willed and bequeathed, ratifying and confirming this and no other to by my last will and testament.
In witness thereof I have hereunto set my name, seal the day and year first above written.
Recorded November 24, 1779.”

According to the History of Perquimans County by Winslow, Jacob is the brother of Israel Perry [this is an error, I think, as Israel states in his will that his father was Jacob smk] and Phillip Perry and was the son of John and Mary Perry. There are missing records in Perquimans County from 1712-1721. There is a J. Perry using 200a of Timothy’s land mentioned in the will of Timothy Clare probated Nov. 10, 1724 , it is unclear whether this is Jacob or his father, John or uncle James. Jacob is listed on the 1735 quits rents list with 300acres. Also listed are Phillip Perry, Benjamin Perry, and Samuel Perry. The Sr. Jacob Perry’s land is mentioned in the will of Daniel Rogerson, Sr. February 13, 1762. A lawsuit over this land mentioned Jacob Perry, Jr., Benjamin Perry, Jr., Joseph Perry, and Phillip Perry among others swearing oath to have examined the land in question of 65A siezed in fee tail for David Rogerson valued at 35¬£. The land was auctioned off and sold to Israel Perry for 65¬£. David Rogerson left Perquimans county for Martin Co. following this court action, he never signed the deed in question with his mark. He later purchased land in the then Tyrel (now Martin Co.) Co. from Samuel Perry of Chowan Co. – -note in – “The Roos Family Tree” by Joy Roos on Ancestry.com

Notice for male NC Perry surname descendants: Please consider having your DNA tested.
Three samples from family subgroup 03 at Perry FTDNA website
http://www.familytreedna.com/public/perry/default.aspx?section=yresults can document their ancestry to John Perry b. 1680/90 of Nansemond Co, VA d. 1760 Bertie Co, NC. A fourth sample from the same subgroup 03 can prove his ancestry to Currituck Co, NC. He does not appear to be a descendant of John Perry d. 1760 in Bertie. It is anticipated that the presently unknown common ancestor of these two lines lived in 17C Virginia. DNA may help tie together the several NC lines out of VA, so please consider joining the Perry surname project. Tests can be ordered at a discount through either the Perry FTDNA website above, or www.perry-dna.org. Other companies (Ancestry, etc) also do DNA testing, and your result can be uploaded to the Perry surname project.

  1. 5. Priscilla Perry ca 1732 –
    married ca 1754 Dempsey Welch ca 1725 – 1792
    son of Nathanaell Welsh

I and many others are at a dead end with my Welch line…. can you tell me where you found the name of Dempsey Welch’s father Nathanaell Welsh? I have done several DNA tests but have found no matches so far.. need other Welch men to test. Any information would be appreciated… it could be a break through for all us in this Welch family.

  2. Thank you for suggesting a DNA test. My brother had his YDNA done and it went to John Perry born about 1649 in Nansemond, VA. John was the son of Phillip Perry who was born in London but immigrated to Isle of Wight. We love your website!

    1. In addition, I would like to point out that Jacob Perry, spouse of Hepzibah Clare, was the son of John Perry born 1649/50 in Nansemond, Va not the son of Joseph Perry. This is born out through DNA tests. John Perry was the son of Phillip Perry of Whitemarsh, Isle of Wight, Va.
Thank you for your wonderful genealogy work.
